X - T FIRE RETARDANT TREATED PLYWOOD
LIMITED WARRANTY

Flame Safe Wood Products, Inc. hereinafter referred to as “Flame Safe” warrants it’s X-T treated plywood when properly installed will perform as tested.

Flame Safe warrants that it’s X-T fire retardant treated plywood meets the requirements as set forth in the ASTM E84 Standard (UL723) and the ASTM D2898 Standard Test Methods for Accelerated Weathering of Fire-Retardant-Treated Wood for Fire Testing. This warranty is limited to the fire retardancy of the X-T plywood only. This warranty applies only to Flame Safe X-T impregnated into plywood in accordance with Flame Safe specifications and labeled that the plywood is Flame Safe X-T treated. For preservative treated plywood impregnated with Flame Safe X-T this warranty will be limited to that stated by the manufacturer of the preservative treated plywood and all other conditions set forth herein.

This warranty shall be void and Flame Safe shall have no liability whatsoever if Flame Safe X-T fire retardant treated plywood, was not kept dry during storage and installation. Flame Safe is not liable by this warranty as a result of abnormal building conditions, poor design, roof leaks, delamination of plywood, poor quality lumber substrate, architect, or builder (including contractors and subcontractors) negligence. The structure must be designed to take into account the published standards and design data for using Flame Safe as set forth in Flame Safe’s published specifications (and are made a part hereof). Flame Safe use must meet all architectural specifications and design standards, such as, but not limited to, adequate ventilation across all surfaces of wood in roof systems (enclosed cavities under flat or vaulted roofs require careful attention to detail to assure adequate ventilation). The roof design must be commonly used in the building industry. The Flame Safe X-T plywood used as roof sheathing must be minimum 15/32" thick. The design value adjustment (DVA) is .9775 for thicknesses of plywood when kiln dried to a moisture content not to exceed 15%.

This warranty is extended only to the Builder for the structure and shall not create any rights to any third party.

This warranty shall be void unless the Flame Safe fire retardant plywood Builder Warranty Agreement has been fully executed by the Builder and delivered to Flame Safe within 30 days of purchase of Flame Safe fire retardant plywood in the structure. Flame Safe’s obligation under this warranty or otherwise, under any theories of misrepresentation, negligence, breach of warranty and/or strict liability in tort, or any other theory of liability in tort or in contract or under the Uniform Commercial Code, shall be strictly and exclusively limited to the cost of the plywood only of that portion of the structure. Under no circumstances shall Flame Safe be liable for incidental or consequential damages. Any action against Flame Safe for breach of warranty shall be commenced within 60 days of the date of purchase.

The Parties acknowledge and agree that this warranty is the complete and exclusive statement of the mutual understanding of the Parties and that it supersedes and cancels all previous written and oral agreements and communications. The customer has determined the Flame Safe X-T plywood is suitable for their intended use. This warranty shall be construed under and in accordance with the laws of the State of Texas and all obligations of the Parties hereto are performable in the Texas County wherein the principal office of Flame Safe is located. Any claim will be limited to the cost of the X-T plywood purchased only.
